Event Outline

A system of costs budgeting has been piloted and recently came into force in England. The English system of costs budgeting applies to all multi-track cases generally except for cases in certain specialist courts such as the Admiralty and Commercial Courts. Parties to these cases were, from 1 April 2013, required to exchange and submit costs budgets for the court’s approval. The Singapore Supreme Court recognises the benefits of costs budgeting and has introduced a pilot scheme based on a modified version of the English system. The objective of the modified regime is to provide the parties with an idea early on of the possible range of legal costs they can expect to recover if they are successful or expect to pay to the other party if they fail. This would enable them to make an informed decision on the management of pending litigation. With an appreciation of the party and party costs, the parties may be incentivised to settle or, at the least, to conduct the litigation in a more cost-effective and proportionate way.
