There has been an inconsistent approach in the enforcement of arbitral awards that have been set aside at the seat. One of the advantages often said of arbitration is that the national courts of New York Convention states should enforce an arbitral award unless one of the limited grounds for refusal is met. This debate will discuss the differing views as to whether an arbitral award that has been set aside by the national courts at the seat can then be enforced in another jurisdiction.
