It is a widely accepted principle that the purpose of contractual damages is said to put the injured party in the position in which it would have been had the contract been performed. Although there must be a causative link between the loss suffered and the event, the measure of that damage can give rise to immense difficulties. Ascertaining the correct measure of damage can become even more fraught where a contract has been terminated.
