Presentation speaker, Dr Mary Mitsi and panel speakers will seek to analyse the ways arbitral tribunals reason their decisions and the use of precedents, customary law, general principles of law and policies in the decision making process. The panel will discuss the issues of legitimacy, predictability, persuasion and law development as functions of an arbitral tribunal’s reasoning in its awards. They will also consider these questions in the context of the SIAC Investment Arbitration Rules.
