This seminar explores the limits of loss-based reasoning in private law, focusing on the award of user damages (and analogous remedies such as Wrotham Park damages) in cases involving wrongful interference with chattel, trespass to land and breach of contractual covenant. The objectives are to: • examine the notion of loss in private law • emphasise the importance of identifying the relevant loss in each case • identify the precise basis of Wrotham Park damages
