The Singapore Convention on Mediation provides a framework for negotiated settlements to be enforced like arbitral awards, obviating an impediment to mediation: the fear that resulting agreements will not be honoured. But it is unclear mediations, particularly those involving state-owned entities (SOEs), will follow in its wake. Other barriers constrain SOEs from settling cases and influence their strategy/tactics in arbitration. Can the obstacles be overcome to facilitate negotiated settlements?
