Event Outline

This lecture will look from the lens of law and economics, starting with the assumption that the purpose of bankruptcy law is to minimize expected creditor losses ex post and thus minimize corporate groups’ cost of debt ex ante. It will include a discussion of the purposes of corporate subsidiaries and whether disregarding the borders among them in bankruptcy would undermine those purposes. The lecture will also compare the treatment of corporate groups under U.S. law and Singapore law.
