This lecture examines how sanctions affect arbitration, from parties’ ability to participate in the arbitration process, to the enforcement of arbitral awards. It also considers the wider implications for transnational system of commercial justice, including escalation of costs and uncertainty, and weakening of arbitration as a reliable means for resolving cross-border disputes.
