The ICJ’s climate change Advisory Opinion identifies fossil fuel production, licensing and subsidies as activities subject to international climate obligations, potentially constituting wrongful acts. It concludes that, while a legal duty to phase out fossil fuels remains uncertain, states expanding production or maintaining subsidies are now on notice.
